BOC 3 application. What is it?
When
starting a business, any business, there are some pre-requisite formalities one
has to comply with in order for the smooth running of the said business. This
being said, if you are starting a new broker firm, then there are some
pre-requisites one has to comply with. One of these pre-requisite formalities
is a Brokers BOC 3 application. A
BOC 3 application has to be submitted to the Federal Motor Carrier Safety
Administration (FMCSA). This is done because there is a requirement, enshrined
in the US federal law, that a broker firm will name a Service of Process (SOP)
agent. This is important compliance without which a broker cannot operate in
any state of the USA. This SOP agent will be authorized to receive and submit
legal documents on behalf of the broker he is representing. This SOP agent can
be a person or an organization, depending on whom the broker chooses to name.
The SOP agent needs to have a designated address and business hours in each
state in which the carrier or the broker is authorized to operate. Also, the
agent needs to be physically available in that state.
Filing Process of BOC 3 application
The
application is submitted electronically on the FMCSA website. In the case of a
motor carrier, the application is to be submitted online on the FMCSA website.
But, in the case of a broker, the application can be submitted on paper.
On the
form, some information is definitely required. Following is the application
required on the application form:
- Full name and address of the carrier (or broker or freight forwarder)
- The person authorized to sign and title
- The name of the SOP agent and address for each state
Blanket Designation and service charges
An
organization can be named as an SOP agent, which will then act in all states
and the district of Colombia granting them blanket designation. The fee charged
by individuals or organizations vary. Some charge an annual fee and some charge
fee for individual compliance services. These additional fees include address
change or expedited BOC 3 application.
Duration of filing a BOC 3 application
Once the application is completed and filed online, the authority document is issued in a few business days. But if a long time has passed, and you don’t get the authority document, you can then contact the FMCSA regarding your broker's BOC 3 application status. You can check whether your operating authority is issued by the FMCSA by visiting their website. In some instances, such as name change, address change, or transfer of authority the BOC 3 application needs to be filed again.
Benefits of Working with an organization
The benefits of working with an organization are that they can designate SOP agents for each state or assign a single agent with a blanket designation. You can also act as your own SOP agent, but then you will only be able to operate in the state you are based. Thus, it is prudent to have an SOP agent with the blanket designation, who will notify you of all the ground developments.
